Minutes of a meeting of the Planning Committee held on Wednesday 2nd. January 2008 at 7.30pm.in the Belle Friday Centre, London Road, Lynsted.
1. Members present.
Cllrs. R.Baxter ( Chairman ) Y. Bowling, H.F.Champion, A.Dawes and T.M.English.
2. Apologies for absence.
Apologies for absence were received from Cllr. J.Disney due to a Swale Borough Council Executive meeting.
3. Minute Taker.
In the absence of a clerk, Cllr. English agreed to record the minutes of the meeting.
4. Time set aside for members of the public to address the Committee. There were no members of the public present.
5. Declarations of Interest.
Cllr. Champion explained he was on the School Board of Governors and that the school was adjacent to the site of application SW / 07 / 1170, Vicarage Farm. After due consideration he decided he could best serve the wider community by considering this application as a parish councillor. Therefore, he would absent himself from any future governors meeting that was likely to comment on the application. ---- Duly noted by the members present.
6. To confirm the minutes of the previous meeting of the Planning Committee held on 11th. December 2007.
Proposed Cllr. Champion that the minutes be confirmed as a true record, seconded Cllr. Dawes and agreed.
7. Matters Arising - There were no matters arising.
8. To consider the following planning applications.
8.1 - SW / 07 / 1170 Demolition of two existing dwellings and commercial buildings and erection of 14 dwellings including live / work units approx. 125m of B1 (A) office enterprise units, stables, garages, parking and paddock. Vicarage Farm. Lynsted.
The chairman explained this was an outline application and following a lengthly discussion it was proposed that the parish council should object to this application on the following grounds :
- That this site was outside the Built - up Area Boundary, encroached into open countryside, and was contrary to the rural restraint policies in the Swale Local Plan
- The access /egress was onto the highway between two dangerous bends and was immediately adjacent to the school entrance and would cause an unacceptable traffic hazard.
- The results of the recently published Parish Plan indicated that over 60% of the residents did not want any further housing within the parish.
- The Lynsted Design Statement under a heading Development Patterns and in it para.24 refers to protecting “ sensitive edges “ . The proposed development would breach the Sensitive Edge of the Lyn Valley.
- Para. 26 refers to settlements being in the most part “ one building deep “ and any new development should continue this tradition.
- It was considered this development would have an adverse impact on the Conservation Area and the setting of adjacent listed buildings.
Proposed Cllr. Bowling, seconded Cllr. Dawes and unanimously agreed.
8.2. SW /07 / 1397 Erection of conservatory and porch. Moonshine Cottage, Kingsdown.
It was felt this proposal was not in keeping with the rest of the building and could not be regarded as a ” modest “ extension. Therefore it was proposed Cllr. Dawes that the council should object to this application, seconded Cllr. Champion and unanimously agreed.
8.3. TP / 07 / 0110 Crown lifting and thinning, clearance of branches from property. Five Oaks, The Vallance, Lynsted. Proposed Cllr. Bowling, seconded Cllr. Champion and unanimously agreed that no objection be offered.
8.4 SW /07 / 1409 Installation of sliding door shopfront, remove lobby and install ac. plant in service yard . 109 London Road, Teynham. Proposed Cllr. Champion, seconded Cllr. Baxter and unanimously agreed that no objection be offered.
9. To consider appeal APP / V2255 / A / 07 / 2060334 / NWF etc. against refusal of planning permission on application SW / 07 / 0959 land adjoining 67 London Road, Teynham. It was agreed to write and support Swale Borough Councils objection to this application and to reiterate the parish councils position and to enclose copies of our previous letters of objection . Proposed Cllr. Dawes, seconded Cllr. Bowling and unanimously agreed
10. Determinations by Swale Borough Council.
- TC / 07 / 0094 Pruning of Yew trees at Bogle , allowed --- noted.
11. Appeal decision by Planning Inspectorate.
- SW / 06 / 0524, 0525, 0526 and 0527 Extension, loft conversion and internal alterations, “ Jeffries “ Claxfield Road, Lynsted, appeals denied ---- noted.
12. Any Other Business for information only.
12.1 Appeal APP / V2255 / C / 07 / 29051962 and 4 against enforcement, Ashley, Cellar Hill, Lynsted. Local inquiry to open on 15th. April 2008 at Swale House and last 2days. ---- noted.
12.2 Following contact from Alison Thompson of English Rural Housing Association it was noted that a formal planning application in respect of affordable housing at Vigo Farm, Lynsted Lane, Lynsted had been submitted to Swale Borough Council. As yet not received by Lynsted with Kingsdown Parish Council.
There being no other business or information the Chairman closed the meeting at 8.41pm. precisely.
