LYNSTED with KINGSDOWN PARISH COUNCIL

Minutes of the Planning Meeting held on Tuesday 30th May 2006 at the Belle Friday Centre, London Road, Lynsted

Present:

Councillors; English (Chairman), Baxter, Champion and Bowling
In attendance; Mr M Jones, Cllr Darling and Julia Kitt (Clerk)

Apologies

Apologies for absence were received from Cllr Barrett, who is on holiday and Cllr Jones

At this stage the Chairman adjourned the agenda for the following statement:-
He reminded the members that a complaint about the conduct of a member had been made to the Standards Board of England, although no copy of the complaint or confirmation had been received.

The Parish council had now received a formal complaint directly from this complainant.

As a result the Chairman will call a Special meeting of the Parish Council as soon as is practicable, having regard to members’ availability and holiday arrangements.

As the council would be discussing a named member, the Chairman ruled this was not in the public interest and therefore it would be a closed meeting, that is not open to the public and will, at this stage, be confidential.

The object of the meeting will be to confirm the procedure for dealing with this complaint in line with the ‘Code of Conduct’.

In the meantime the Chairman stated he did not want anyone to approach the complainant, that is to speak or correspond with him on this matter.

The only person to have contact with the complainant should be the clerk and that should be in writing at the direct instruction of the Chairman or as a result of an instruction from a Parish council meeting.

If an approach was made to a member then the Chairman would expect this to be recorded with the Clerk.

The Chairman further suggested that members should not speculate on the outcome of this issue and to avoid any comment outside of the meeting.

Finally, the Chairman had instructed the Clerk to respond to the complainant’s letter of the 28th May 2006, acknowledging receipt and explain we would contact him in due course informing him of our decision.  This letter to be sent by first class post.

The meeting reverted to the published agenda

Public Speaking

Mr Jones wished to talk about Scheme B from SW/06/0524/5/6/7.  The Footprint of the design was the same as the application that has already been given permission.  The cellar would be a utility room and the 2nd chimney would be removed. The Cat slide roof to the kitchen extension would be reinstated. The Porch arrangement had been tidied.

Declarations of Interest

Cllr Baxter declared an interest in SW/06/0500.  He had made representation personally

Minutes of the last meeting

The Minutes of the meeting held on the 24th April were agreed. Proposed by Cllr
Champion and seconded by Cllr Bowling.

Matters arising

The Standards committee will be looking at the advice given by K.A.P.C. relating to
‘declaring an interest’.

The Land registry searches for affordable houses were sent to Jennifer Shaw.

At the last planning meeting an update on the planning application for ‘The Cherries’
was requested but was superceded by the following planning application.

Local Plan

We objected to the positioning of the Eastern boundary of the Thames Gateway, during the Swale local plan process. Our argument was that the boundary should follow the alignment of the Northern Distributor Road and the Southern Distributor Road, if this road is approved. This would leave our parish outside the Gateway; more appropriate since it is a rural parish. We were advised that the Swale Local Plan cannot consider the position of this boundary.

The consultation on the South East England Plan has commenced. This presents a
second chance to approach this issue.  It was agreed to frame an objection to the position of the Thames Gateway boundary in this forum, which should have to power to make such changes.  It was also proposed, in the present continuing state of uncertainty about the Southern Distributor road, that we make the more definite suggestion that the boundary be aligned along the Western boundary of the Parish of Bapchild and Tonge and the eastern boundary of Rodmersham.  In other words, tightly around the eastern edge of Sittingbourne, but following established civil boundaries.  This was agreed.

Planning Application

Re Application SW/06/0524/5/6/7 Extension, loft conversion, internal alterations at Jeffries, Claxfield Lane

Major parts of the proposed modifications to this building were objected to at the time of an earlier application.  Many of these features now have approval.

The Planning Committee looked at two possible schemes: Scheme A and Scheme B.

  • Scheme A, involving a hipped roof added to a catslide, provided an over-complicated fussiness to the roofline.  This would be out of keeping with the remainder of the roof. Scheme A was objected to.
  • Scheme B was considered. The idea of providing an architectural treatment that differentiates the new build from the original building was discussed.

There was no objection to Scheme B.  This was proposed by Cllr Baxter, seconded by Cllr Bowling and agreed.

Re application SW/06/0427 New dwelling at land adjacent to Five Oaks, The Vallance, Lynsted

The application differed from the prior application in that it was brought forward three metres.  This was an improvement.  The Council did not object.

Re application TC/06/0049 Root pruning and crown reduction of one Yew Tree by no more than 30% at Bogle, Lynsted Lane

The roots of the tree in the above application are contributing to the ‘lean ‘of a wall in the grounds.  These would have to be pruned, for this reason the height should be reduced. The Council did not object but would ask that the pruning is completed sensitively such that it keeps its original shape.

Re application SW/06/0500 Temporary siting of two twin unit caravans and one touring caravan for gypsy family at The Cherries,  Cambridge Lane

The Council felt that there had been no change from the original application in July of 2003. The Inspector at the appeal had said the site was not suitable and it remained so. The Council therefore objected to this application

SW/06/0462 Extension to ground floor at rear of existing building and conversion from public house to 8 flats at The Fox Public House, 191 London Road. This application had been presented to Teynham Parish Council and was noted.

Swale Borough Council Planning Decisions

SW/06/0310 4 new 2 storey 3 bedroom properties with associated parking and vehicular pedestrian access had been refused permission by Swale Borough Council
